Warranty Terms – Basil FX Mattress

10 Years Limited Product Warranty

In accordance with the stipulations outlined in these Warranty Terms and Conditions (referred to as the “Conditions”), Foams India Bed Products (referred to as the “Company”) extends the following limited warranty offer to its customers (referred to as the “Customer”) for the Foams India Basil FX Mattress (referred to as the “Mattress”) distributed by the Company or its authorized dealers. This warranty covers manufacturing defects (“Manufacturing Defect”) and remains valid for a duration of 10 years, starting from the date of Mattress purchase from the Company or its authorized dealers (referred to as the “Warranty Period”).

 
a) In the event of a Manufacturing Defect occurring and being duly reported to the Company (in accordance with the procedure and requirements outlined in Clause 5 of these Conditions) within the initial 
1-year period of the Warranty Period, the Company retains the discretion to either effect repairs or provide 
a replacement for the defective Mattress.
 
b) If a Manufacturing Defect becomes evident and is reported to the Company (in compliance with the procedure and prerequisites stated in Clause 5 of these Conditions) after the first year of purchase, the Company retains the sole discretion to either effect repairs or offer a replacement for the mattress. In such cases, a warranty fee (covering material, labor, and transportation) will be levied on a Pro Rata basis, payable by the Customer. Should the Company opt for repairing the Mattress, the Customer’s payable warranty fee shall encompass the expenses associated with materials and labor essential for the repairs, as itemized in the invoice issued by the Company to the Customer. In instances where the Company deems replacement of the Mattress necessary, the Customer’s payable warranty fee to the Company shall be computed according to the following methodology:

* Price of the mattress is arrived as per the Published Pricelist of the product at the time of warranty claim.
Exclusions and Limitations of Liability
 
The Warranty concerning the Mattress shall not apply in the instances outlined below:
 
(a) Minor imperfections and slight cosmetic discrepancies;
 
(b) Fabric Color Variation: The fabric color may exhibit minor deviations from the depicted image;
 
(c) The Company deems the reported defect to have resulted from misuse, abuse, improper storage, inadequate maintenance, or unauthorized repair
 
(d) Alteration or Modification of the mattress in any manner, rendering the Warranty null and void. This encompasses actions such as cutting labels, removing inner stitched covers, or adding layers above or below the Mattress by the Customer
 
(e) Damage stemming from improper utilization of an incompatible bed frame, hinges, foundation, box spring, or base, as determined by the Company 
 
(f) Employment of the Mattress for purposes beyond its intended usage. The Mattress is designed solely for human sleep, rest, and recline, while placed flat on a uniformly even and firm surface. Any other application of the Mattress will be classified as misuse and falls outside the purview of the Warranty;
 
(g) Natural wear and tear of the Mattress, including its fabric, cover, and stitching;
 
(h) Damage arising due to the Customer’s failure to maintain the Mattress in a clean, tear-free condition, including protection against stains, bodily fluids, burns, spills, insect infestations, etc.;
 
(i) Softening: The ordinary softening of the Mattress resulting from regular usage is a natural outcome and is thus excluded from Warranty coverage. The aging process of natural, biodegradable, eco-friendly Latex mattresses may lead to deterioration, discoloration, or hardening of the top surface, which are not encompassed by the Warranty;
 
(j) If the reduction in Mattress thickness is less than 20% of the original thickness as indicated in the purchase invoice
 
(k) If the Mattress dimensions fall within the Tolerance Limits for Length, Width, and Thickness as specified for Natural Latex mattresses 
 
(l) Comfort/Firmness Preference: Any description of Mattress comfort level is purely indicative, and the Company does not assure the exact firmness or softness of the mattress. Nor does it guarantee that a particular comfort preference will align with the Customer’s preferences. The Company’s firmness values, based on internal research and development , may differ from the Customer’s understanding. Therefore, the Company cannot guarantee the Mattress will match the Customer’s perception of firmness;
 
(m) Damage due to excessive moisture/humidity, temperature, or extreme environmental conditions leading to tearing or permanent deformation of the Material;
 
(n) Mattresses maintained in unhygienic or unsanitary conditions that could impair the Mattress and void the Warranty. The Company reserves the right to decline inspection and deny Warranty claims for such Mattresses due to worker health and safety concerns.
 
3.The Warranty’s scope is limited to the mattress’s value as indicated in the original purchase invoice, and the Company shall not be liable for any damage, injury, or adversity faced by the Customer under any circumstances.
 
4.The Company does not make any medical or health assertions concerning the Mattress or other products. Allergies, backaches, discomfort, or any other physiological conditions experienced by the Customer are not covered by this Warranty. Queries or issues related to the user’s medical or health conditions should be addressed by a Licensed Physician and not by the Company.

Claim Procedure

 
(a) To initiate a claim under the aforementioned Warranty, the Customer must send an email to the Company at [email protected], providing a clear description of the Mattress issue, accompanied by photographs of the defect captured from various angles, along with a copy of the original purchase invoice and the original Warranty Card for the Mattress.
 
(b) The Company retains the sole discretion to (i) request additional photographs, information, and/or descriptions from the Customer; and/or (ii) conduct a physical inspection of the Mattress, either through the Company’s representatives or authorized agents, before accepting a specific claim under this Warranty.
 
(c) Failure to adhere to the above instructions will render the Customer’s Warranty claim invalid.
 
(d) Upon successful verification of the claim to the Company’s satisfaction, the Company will, at its own discretion, proceed with repairing or replacing the Mattress, subject to the stipulations outlined in Clause 1 of these Conditions.
 
(e) Presentation of the Warranty card and purchase invoice is mandatory for any Warranty claim, and without these documents, the Warranty claim will not be deemed eligible.
 
(f) This Warranty holds validity only when it bears the stamp and signature of an authorized dealer or the Company from which the Customer purchased the Mattress.
 
(g) Should a defect arise and to avail the benefits of this Warranty, the Customer must send back the Mattress to the Company at the Customer’s expense, accompanied by copies of the purchase invoice and Warranty card. The transportation costs for sending the Mattress for replacement/repair, as well as the return transportation costs, will be the responsibility of the Customer. If the Mattress needs to be inspected by Company personnel and is located 100 Kilometres or more from a Company branch office, the Customer will bear the costs associated with the inspection visit. In the event that the Company acknowledges the validity of the claim, the Company will reimburse the costs incurred by the Customer for such personnel visit.
 
(h) The Warranty applies exclusively to the foam material of the Mattress and does not extend to the fabric cover, zipper, mattress cover, etc.
 
(i) Despite the provisions of Clause 1(a) above, if any Manufacturing Defect covered by the warranty emerges within the initial 1-year period of Mattress purchase and the exact model is unavailable, the Company reserves the right to substitute the mattress with another model that, in the Company’s view, is comparable and compatible in terms of dimensions. If no suitable substitute is accessible, the Company may offer the Customer credit on a Pro Rata basis, as per the formula below. This credit can be utilized by the Customer towards the acquisition of any other model from the Company’s product range:

(j) The Warranty Period for a replaced or repaired product shall automatically adjust to the remaining duration, calculated from the initial sale date of the Mattress.
 
(k) This limited warranty is exclusively applicable to the original Customer.
 
 6. Any disputes arising from or related to this Warranty shall fall under the exclusive jurisdiction of the courts situated in Chennai,Tamil Nadu.
 

USE AND CARE INSTRUCTIONS:

(a) It is advised to always use the Mattress with its protective cover or a bedspread to prevent staining and soiling;
 
(b) Refrain from removing any labels affixed to your Mattress;
 
(c) Avoid folding or storing the Mattress. Bending, folding, dragging, standing, or jumping on the Mattress can result in damage;
 
(d) Minimize exposure to excessive moisture, humidity, temperature fluctuations, or extreme environmental conditions;
 
(e) When reversing the Mattress, exercise caution to evenly distribute pressure and prevent strain on specific areas while lifting. Lift the Mattress gently and roll it over to the other side;
 
(f) Refrain from sitting on the edges of the Mattress and avoid prolonged and habitual sitting on the same spot.

Warranty Terms – Basil FX Mattress
